Terms and conditions of sales

1. Object

The following provisions constitute a contract establishing the terms and conditions for the remote sale of products from Espresso's e-commerce site, concluded between:
a trader registered in France (Espresso, a legal person acting in his professional activity) and a consumer (person acting outside his professional activity) under a remote sales system.

3. Price

Prices are shown in euros with all taxes included. Prices are those in effect on the day of the order. They take into account the VAT applicable on the day of the order. Any change in the VAT rate will be automatically passed on to prices.

For any delivery outside the European Union, customs taxes and formalities are, unless otherwise stated, at the exclusive expense of the customer who undertakes to verify the possibilities of importing the products into the country of delivery.

4. Order

Ordering implies full and irrevocable adherence to these terms and conditions of sale. Any order by the Customer constitutes an acceptance of the prices and description of the products available for sale. The sale will only be considered final after Espresso sends the Customer confirmation of the order and the customer receives the full price. The automatic registration systems of the site are considered to be worth proof of the sales contract and its date, Espresso undertakes to honor the orders received on the website only within the limit of the available stocks of the products. In the absence of product availability, Espresso undertakes to inform the customer as soon as possible.

5. Payment

By Bank Card: The validation of the order using the credit card number and the expiry date is worth paying the full amount of the order. Credit card data is kept only during the order processing time (secure communication protocol).

By Paypal: PayPal is the world's leading online payments company. PayPal encrypts and protects your card number,
PayPal allows you to pay online without disclosing your financial information during the transaction, we do not in any way safeguard credit card details.

By Check: Payments can be made by cheque in euros, issued by a French bank, at the behest of Espresso. Write your details on the back of the cheque, attach a copy of an ID and post your payment to:


The acceptance of the order and its processing will only be effective when the cheque or payment is received by card or bank transfer.

6. Confirmation

The following contractual information will be the subject of a confirmation email after the customer validates the order containing the following information:

- The unique order number
- the total amount of the order, its TTC or HT price and the amount of the delivery fee
- the means of payment chosen by the Customer
- delivery address
- the identity and references of the merchant with the geographical address where the consumer can file his claims

7. Execution

The order duly accepted by Espresso under the conditions recalled in point 4 of these Terms of Sale will be executed no later than 7 days.

If the product ordered is unavailable, the Customer will be informed as soon as possible and will have the option to cancel his order. He will then have the choice of requesting either the exchange of the product or the refund of the sums within 30 days of the application date.

8. Delivery

All orders will be delivered in a closed, solid and discreet shipment, at the address indicated by the Customer. Only settled orders will be shipped. In addition, Espresso reserves the right to refuse any order from a customer with whom an ongoing dispute exists. On delivery, the Customer is required to check the condition of the packaging and the goods and in case of damage, to make reservations immediately on the transport voucher, as well as to the Customer Service of Espresso by email, or phone.
Espresso delivers all over France.
If the package returns for a few reasons, the customer is notified by email. Without a response from him within 3 months of shipping this mail the parcel will be considered abandoned.

9. Port fees

Deliveries are made via the Colissimo Postal Tracking system. The amount of delivery costs varies depending on the weight of the products ordered.
The postage represents only the postage charged by COLISSIMO without any overcout, the insurance costs are covered by Espresso.

10. Guarantee

In the event of non-compliance or defects in the product delivered, the Customer will have to inform Espresso Customer Service by email or phone, which undertakes to remedy the problem as soon as possible. In any event, Espresso assumes responsibility for the products delivered in accordance with the regulations in force, and therefore guarantees the customer against any claim or claim, judicial or amicable, resulting both from damage to property and damage to persons, as a result of those products. Espresso also guarantees, in accordance with the legal provisions, the Customer, against any hidden defects affecting the products delivered and rendering them unfit for use, as well as the resulting damaging consequences. All our items are guaranteed 7 days from the date of purchase. Only items are included in their original packaging. Shipping costs will remain the responsibility of the applicant. A delay of 3 weeks is to be expected.

11. Retraction period

Under the provisions of Articles L 121-16 and the following provisions of the Consumer Code, the consumer has a withdrawal period allowing him to forego his purchase within 14 free days of delivery.

It is imperative that he first indicate his intention to return the parcel as part of the exercise of his right of withdrawal by contacting us via our contact form.

The products must not have been used, they must be returned to the company Espresso at the consumer's expense and under its responsibility, for him to carry out the insurance of transport, in perfect condition of resale, in their original packaging and showing no signs of shock or malfunction. Consumable products are taken back and exchanged provided they are in perfect condition and not open; Subject to compliance with the above provisions, Espresso will refund the products ordered for the amount paid on the purchase order (the return fee is borne by the customer) within 14 working days of receipt of the products (legal deadline). No refund can take place if the products are not in their original packaging, which must be completely intact. Under articles L 121-16 and following of the consumer code, professionals cannot claim the right of withdrawal or the "satisfied or refunded" guarantee.

12. Returns

The return is after requesting a return requested via our contact form and after explaining his reason. The consumer has 14 free days as soon as the parcel is received to make his request. Only returns of perfectly intact products are accepted (with the exception of returns motivated by product malfunction).
No return of article can be accepted without prior request and approval by email.
The risks of transport are entirely the responsibility of the shipper, and it is therefore up to the sender to carry out all due diligence regarding the safety of the transport, including by ensuring its delivery. The return costs are entirely at the sender's expense, except in case the return is motivated by an error by the company Espresso in the preparation of the order. Any product returns concerning a product that is not properly packaged, the packaging of which has been opened or which, after examination, would not prove to be defective, will not be accepted. It will then be up to the sender to pick up the package at his own expense.

13. Information and freedoms

The information that is requested from the Customer is necessary to process his order and cannot be communicated to third parties. In accordance with the French "Computers and Freedoms" law of 6 January 1978, the Customer may object to such communication and has the right to access, modify, correct and delete personal data concerning him. To exercise this right, contact Espresso.

14. Security

Espresso ensures that the cryptology means and services used to secure transactions have been authorized or de-reported under current legislation.

15. Signature - proof

The validation of the command associated with the authentication procedure and the protection of the integrity of the messages is an electronic signature with the same value between the parties as a handwritten signature. Computerized records, stored in Espresso's computer systems under reasonable security conditions, will be considered evidence, communications, orders and payments between the parties. The archiving of orders and invoices is carried out on a reliable and irreversible medium in order to correspond to a faithful and lasting copy, in accordance with Article 1348 of the Civil Code.

16. Intellectual Property

All texts, comments, books, illustrations and images reproduced on the sites published by Espresso are reserved for copyright, intellectual property and for the world. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private use is permitted subject to different or even more restrictive provisions of the intellectual property code. Any other use is infringing and sanctioned under the Intellectual Property unless written prior authorization from Espresso . Full or partial reproduction of sites published by Espresso is strictly prohibited.

17. Complete contract

If, for any reason, any of these terms and conditions were to be declared unenforceable, this inapplicability would not affect the application of the other provisions of the terms and conditions, the one deemed unenforceable would then be replaced by the provision as close as possible.

18. Responsibility

Neither Espresso nor the Customer can be held responsible for any non-performance that originated in a case of force majeure, beyond their control, including, without limitation, cases of war, riot, insurrection, interruption of transport, import or export problem, strike, shortage, fire, earthquake, storm, flood. The Customer is solely responsible for the choice of products, their preservation and their use by himself or by a third party.

19. Litigation

The language of the contract is French. The contract is subject to French law. Disputes will be the jurisdiction of the jurisdiction of the Commercial Court of Marseille.
